SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA
RULE NO.: 8.52 RULE TITLE: Construction Change Orders
PURPOSE AND EFFECT: To modify the existing policy and to update procedures relating to change orders for construction and timelines.
SUMMARY: These revisions align the policy with changes made during the 2025 Legislative Session.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The School Board has determined that this rule will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: No SERC is required at this time by FS 120.54 or FS 120.541. In the event a SERC becomes required, the School Board of Sarasota County, Florida will promptly prepare one.
Any person who wishes to provide information regarding the statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

THE FULL TEXT OF THE PROPOSED RULE IS:


The Director of Construction Services is authorized to approve Construction Change Orders modifying general contractor agreements subject to the following limitations:
I. Change orders totaling $50,000 or less shall be approved by the Director of Construction and submitted to the board for notification;
II. Change orders in excess of $50,000 shall be submitted to the board for approval.
III. If a price quote is received from the school district’s contractor for a change order requested or issued by the district for construction services and the price quote conforms to all statutory requirements and contractual requirements for the project, the district must approve or deny the price quote and send written notice of the decision to the contractor within 35 days after receiving the quote.  The denial notice must specify the alleged deficiencies in the price quote and the actions necessary to remedy the deficiencies.  If the District fails to provide the contractor with a notice, the change order and price are deemed approved and the district must pay the contractor the amount stated in the price quote upon completion of the change order.
