The feasibility
study has been completed and received by county staff. In
mid-2007 the project was put on hold when staff became aware of
privately owned submerged land within the project area.
County staff
drafted a temporary dredge and construction easement that was
approved by the county attorney in January 2008. The Sarasota
County Real Property office initiated contact with the owner of
the submerged land in order to obtain an easement which would
allow privately owned sediment to be removed.
In May 2008,
the owner of the submerged land contacted the county requesting
revisions to the easement language. Following review of the
request by the county attorney, the Florida Department of
Environmental Protection (FDEP) was contacted to verify that the
State does not claim ownership of the submerged land.
A response from
FDEP has been received and county staff held a meeting to
discuss the project. Based on the information received from FDEP,
Sarasota County Survey/Mapping staff was able to accurately
depict the privately-owned submerged land and verify that an
easement is not needed for the Baywood Avenue D project because
the privately owned submerged land will not be impacted by the
project.
A neighborhood
meeting was held April 1, 2009 at the Edson Keith House at
Phillippi Estate Park. County staff and the project engineer
hosted the meeting and presented the feasibility study, the
proposed dredge channel and the cost estimate.
Staff mailed a
Project Unit Approval Petition to the nine project properties
via certified mail. Property owners who support the project need
to sign, notarize the petition and submit it to: Paul Semenec,
Capital Management Services, 1001 Sarasota Center Blvd.,
Sarasota, FL 34240. Property owners who do not support the
project can simply disregard the petition. No action is needed
on their part.
The project will be on hold until
eight petitions are received. Of the total of nine properties,
eight petitions are the required 80 percent of the total. To
date, one petition has been received. |
