Charter Amendment

The following proposed Charter amendments will be on the Aug. 26 primary election ballot.

Amendment 1 - Timing for future amendments

  • Changes the timetable for filing and voting initiatives

  • States that if the County Commission questions the legality of a proposed amendment,
    it is obligated to seek judicial review to determine lawfulness

  • Establishes a two-year petition signature expiration period  

a)  Petition-initiated amendments would be submitted to voters at the next countywide election if the signatures are verified at least 120 days before the election. This allows 30 days to prepare the ordinance calling for the election and 90 days for the Supervisor of Elections to prepare for the election. If the next countywide election is more than a year from the date when the signatures are verified, the petition-initiated amendment would be submitted to voters at a special countywide election within 180 days following signature verification.

 

b) Board-initiated amendments would be submitted to the voters no sooner than 90 days after the date that the County Commission adopts an ordinance calling for a referendum election. This timeframe is shorter because the ordinance calling for the election already has been prepared.

 

c) Charter Review Board amendments will be submitted to the voters at the next countywide election. This is the current language in the Charter. The only change is that the ordinance calling for the special election must be filed with the Supervisor of Elections at least 90 days before the next election to allow sufficient time for processing.

Amendment 2 - Fiscal impact of proposed Charter amendments 

  • Allows the County Commission to adopt an ordinance that establishes a procedure to issue a statement to the public before a referendum about the financial impact of a proposed amendment.
